1. About these terms
These terms govern your use of the ChickPoint website and the services we provide through it. By creating an account, creating a profile or otherwise using ChickPoint, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use ChickPoint.
2. What ChickPoint is
ChickPoint is an online directory. It helps farmers, riders, veterinarians, suppliers and other people in the chicken business in Uganda find and contact one another. Browsing the directory is free.
ChickPoint is not a party to any sale, delivery, service or other arrangement between users. We do not hold money on behalf of users, we do not set prices, and we do not guarantee that any bird, product or service will be supplied.
3. Eligibility and your account
You must be at least 18 years old and able to enter into a binding agreement. You must give accurate and current information and keep it up to date.
You sign in with your phone number and a password. You are responsible for keeping your password private and for everything that is done through your account. Tell us promptly if you think someone else has used it.
4. Profiles and approval
Profiles are reviewed before they appear in the directory. We may approve, refuse or remove any profile at our discretion, for example where information is incomplete or misleading, or where these terms have been broken.
Approval means only that we have reviewed the profile. It is not a guarantee or endorsement of the person, their qualifications, licences, products, services or conduct. You should make your own checks before dealing with anyone.
5. The platform fee
People who list a profile pay a platform fee, which helps us maintain and run the service. The fee is shown on the payment page before you pay. Payment is made by Mobile Money to the merchant details shown there, and you must then send proof of payment as instructed.
Your profile is approved once we have confirmed your payment, and it stays active for the period that applies to the fee you paid. Fees are not refundable once your profile has been approved, unless we decide otherwise or the law requires.
We may change our fees. A change applies to payments made after we announce it.
6. Your content
You keep ownership of the content you submit, including your name, photo, descriptions and listings. By submitting it, you give us a free, non-exclusive licence to host, display, reproduce and share it on and in connection with ChickPoint, so that we can run the directory.
You confirm that your content is accurate, that you have the right to use it, and that it does not infringe anyone else’s rights.
7. Rules of use
When you use ChickPoint, you agree not to:
- give false or misleading information, including about the age, health, breed, quantity or price of birds, or about your identity or qualifications;
- impersonate another person or business;
- list products that are unlawful, unsafe, counterfeit or expired, including veterinary medicines;
- harass, threaten or defraud other users;
- use contact details shown on ChickPoint for unsolicited bulk messages, advertising, or any purpose other than a genuine enquiry;
- collect profile information in bulk, whether by automated means or otherwise;
- interfere with, or try to break, the security or operation of the site; or
- break any law.
8. Dealing with other users
Any agreement you make with another user is between you and that user. You decide whether to deal with someone, and you do so at your own risk. We encourage you to confirm the condition and price of birds and products, to check any licence or qualification you rely on, and to arrange payment and delivery carefully.
We are not responsible for the quality, safety, health or legality of anything offered through ChickPoint, for advice given by any veterinarian or supplier, or for any loss, injury or dispute between users. We may help resolve a complaint, but we are not obliged to.
If you believe a profile is misleading or unsafe, tell us through our support chat and we will look into it.
9. Suspension and removal
We may suspend or remove a profile or account, with or without notice, if we believe these terms have been broken, if other users could be put at risk, or if the law requires it. You may stop using ChickPoint at any time and may ask us to delete your account through our support chat. Removal does not entitle you to a refund of fees already paid, except as set out in section 5.
10. Our rights in the service
The ChickPoint name, logo, website design and software belong to us or our licensors and are protected by law. You may not copy or reuse them without our written permission, other than by using the site as intended.
11. Disclaimers
ChickPoint is provided on an “as is” and “as available” basis. We work to keep the service running and the directory accurate, but we do not promise that it will be uninterrupted or free of errors, or that the information in it is complete or correct. We may change, pause or discontinue any part of the service.
12. Limits on our liability
To the fullest extent the law allows, ChickPoint and the people who run it are not liable for any indirect or consequential loss, for loss of profit or business, or for any loss that arises from your dealings with other users or from your reliance on information in the directory.
Where liability cannot be excluded, our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these terms limits any liability that cannot be limited by law.
You agree to compensate us for any loss we suffer because you have broken these terms or the law.
13. Privacy
How we handle personal information is set out in our Privacy Policy. Please read it, in particular the section explaining that your name, photo, location and phone number are shown publicly once your profile is approved.
14. Changes to these terms
We may update these terms from time to time. When we make an important change, we will update the date at the top of this page and, where appropriate, tell you directly. If you keep using ChickPoint after a change, you accept the updated terms.
15. Governing law
These terms are governed by the laws of Uganda. Any dispute that we cannot resolve informally will be decided by the courts of Uganda.
